These terms apply to the ordering, purchase and delivery of Goods from the Website, In-Store and through our customer service, and form a contract between you and Myparts Online Sdn Bhd of 1888 Lorong Makmur 3/2 Taman Industri Makmur, Lunas 09600 Kedah, Malaysia. (Terms). You agree that these Terms (as amended from time to time) will apply to all of your Orders.

  • Compliance with Terms

You will be bound by these Terms each time you submit an Order. Each Order you place will be a separate contract between you and Myparts for the supply of Goods.

  • Ordering goods

Any order placed by you in the manner described in this site is an offer by you to purchase a particular product or service for the price (including the delivery and other charges) specified on this site at the time you place your order. You acknowledge that, by placing your order, you are agreeing to pay for and accept delivery of the goods ordered unless you ask us to cancel that order, and we send you written confirmation of the cancellation prior to the goods being dispatched to you. Subject to your compliance with any product specific limitations shown on this website. Myparts may change the prices published on the Online Content at any time. Prices of products placed in the 'basket' but not paid for are also subject to change and you agree to pay the price current at the time of payment. While every effort has been made to ensure the accuracy of prices, images and information displayed on this site, Myparts is not responsible for any error and reserves the right to accept or reject your offer for any reason, including without limitation, the unavailability of any product, an error in the price, image or the product description posted on this Online Content, or an error in your order. We may require additional verification or information before accepting any order. We only accept orders from within mainland Australia and Tasmania. Within this area, our policies as to delivery and returns apply as set out in these Terms of Use.

Order Cancellation
All orders are electronically processed and forwarded to the warehouse immediately upon confirmation of the order. Therefore, there is a very short time for order cancellations. If you wish to cancel your order, you must do so BEFORE you receive the "Invoice" e-mail. No orders can be cancelled after Invoice has been confirmed and issued, as the order has been processed for shipment. Restocking fees will be applied for any cancellation after order has been processed.

Product availability may vary between Myparts retail stores and Myparts online due to different customer offers. Prices displayed on online are current at the time of issue, but may change at any time and are subject to availability. Prices and availability of items are subject to change without notice. Where permitted in all states, we reserve the right to limit sales, including the right to prohibit sales to re-sellers.

Risk and title in the Goods passes to you on the date and time of delivery of the Goods by the delivery agent or when you or your appointed agent collected in store. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Myparts may provide an additional warranty in addition to your Consumer Law rights and remedies. When provided, the warranty period, provisions and the person providing the warranty relating to your purchase vary according to the product you have purchased. Please refer to product packaging and brochures to determine the warranty term and warranty conditions for your purchase. Myparts excludes to the fullest extent possible under Law, all implied terms and warranties whether statutory or otherwise, relating to the subject matter of these Terms.

You represent and warrant to Myparts that Myparts will not be liable for any expense or injury (including indirect loss such as loss of revenue, profits, anticipated savings, goodwill or business opportunity, injury to your reputation) in contract, tort, under statue or otherwise, howsoever caused including arising directly or indirectly from or in connection with these Terms. Our liability to you for loss or damage of any kind arising out of these Terms will be reduced or limited to the extent (if any) that you cause or contribute to the loss or damage.

  • Termination

We may, at our discretion, terminate the agreement for the supply of Goods to you:

  1. for convenience, at any time, on giving notice to you; or
  2. immediately if Myparts reasonably believes that you have breached these Terms

and:

  1. that the breach is not capable of remedy; or
  2. if you have been provided with notice of the breach, and you have failed to remedy

that breach within 14 days (where the breach is able to be remedied).
